(二)假冒他人专利的；

2. Infringe on and use other's patent rights;

(三)贬低其他生产经营者的商品或者服务的；

3. Denigrating the commodities or services of other producers or managers;

(四)广告中未经同意使用他人名义、形象的；

4. Use of the names or images of others without prior consent; and

(五)其他侵犯他人合法民事权益的。 

5. Other acts that infringe upon the civil rights and interests of others.

第四十八条 当事人对行政处罚决定不服的，可以在接到处罚通知之日起十五日内向作出处罚决定的机关的上一级机关申请复议；

Article 48 Upon a refuse to accept administrative punishments, a person should apply for a review with the organ at the next higher level within 15 days starting from the date of receiving the notice of punishments. 

当事人也可以在接到处罚通知之日起十五日内直接向人民法院起诉。

The person concerned may also bring the case directly before the people's court within 15 days starting from the date of receiving the notice of punishments.

复议机关应当在接复议申请之日起六十日内作出复议决定。当事人对复议决定不服的，可以在接到复议决定之日起十五日内向人民法院起诉。

The organ of review shall take the review decision within 60 days starting from the date of receipt of the application for review. If the party concerned refuses to accept the decision of the review, it may bring the case before the people's court within 15 days starting from the date of receipt of the notice of review decision.

复议机关逾期不作出复议决定的，当事人可以在复议期满之日起十五日内向人民法院起诉。

If a review organ fails to take a decision within the time limit, the party concerned may bring the case before the people's court within 15 days starting from the date of expiry of the review period.

当事人逾期不申请复议也不向人民法院起诉，又不履行处罚决定的，作出处罚决定的机关可以申请人民法院强制执行。 

If a party concerned fails to apply for a review or bring the case before the people's court and yet refuses to implement the punishment decision, the organ which has taken the decision may apply with the people's court for compulsory enforcement.

 第六章    附  则 

CHAPTER SIX SUPPLEMENTARY PROVISIONS

第四十九条 本法自1995年2月1日起施行。本法施行前制定的其他有关广告的法律、法规的内容与本法不符的，以本法为准。

Article 49 The law shall be in force starting from February 1, 1995. Should any laws and regulations concerning advertising promulgated before the enforcement of this law come into conflict with this law in contents, the provisions of this law previal.
