ies for environmental protection of a coal mine construction project must be designed, constructed, checked and accepted, and put into use simultaneously with the main project. 第三章煤炭生产与煤矿安全 CHAPTER III PRODUCTION OF COAL AND SAFETY OF COAL MINES 第二十二条煤矿投入生产前，煤矿企业应当依照本法规定向煤炭管理部门申请领取煤炭生产许可证，由煤炭管理部门对其实际生产条件和安全条件进行审查，符合本法规定条件的，发给煤炭生产许可证。 Article 22 Before a coal mine is put into production, the coal mining enterprise shall, in accordance with the provisions of this Law, submit an application to the department in charge of the coal industry for coal production license. The said department shall examine its actual production and safety conditions before issuing to it the coal production license if the requirements prescribed in this Law are met. 未取得煤炭生产许可证的，不得从事煤炭生产。 Anyone who has not obtained the coal production license shall be forbidden to engage in coal production. 第二十三条取得煤炭生产许可证，应当具备下列条件： Article 23 The following requirements must be met for obtaining the coal production license: （一）有依法取得的采矿许可证； (1) having the legally obtained mining license; （二）矿井生产系统符合国家规定的煤矿安全规程； (2) having a mine production system that conforms to the mine safety rules formulated by the State; （三）矿长经依法培训合格，取得矿长资格证书； (3) having mine managers who have received training according to law and obtained the mine manager qualification certificates; （四）特种作业人员经依法培训合格，取得操作资格证书； (4) having specially skilled workers who have received training according to law and obtained the operation qualification certificates; （五）井上、井下、矿内、矿外调度通讯畅通； (5) having a good communications system for dispatch on the surface, underground, within and out of the coal mine; （六）有实测的井上、井下工程对照图、采掘工程平面图、通风系统图； (6) having an actually measured surface and underground engineering comparison drawing, a mining and excavation plan and a ventilation system drawing; （七）有竣工验收合格的保障煤矿生产安全的设施和环境保护设施； (7) having the facilities to guarantee coal mine safety in production and environmental protection facilities, which have been proved up to the standard through the acceptance test conducted upon completion of the project; and （八）法律、行政法规规定的其他条件。 (8) other requirements prescribed by laws and administrative rules and regulations. 第二十四条国务院煤炭管理部门负责下列煤矿企业的煤炭生产许可证的颁发管理工作： Article 24 The department in charge of the coal industry under the State Council shall be responsible for the administration of the issue of coal production licenses to the following coal mining enterprises: （一）国务院和依法应当由国务院煤炭管理部门审查批准开办的煤矿企业； (1) coal mining enterprises that are examined and approved for establishment by the State Council and those that are, in accordance with law, subject to examination and approval for establishment by the department in charge of the coal industry under the State Council; and （二）跨省、自治区、直辖市行政区域的煤矿企业。 (2) coal mining enterprises that are established in trans-administrative regions of provinces, autonomous regions and municipalities directly under the Central Government. 省、自治区、直辖市人民政府煤炭管理部门负责前款规定以外的其他煤矿企业的煤炭生产许可证的颁发管理工作。 The departments in charge of the coal industry under the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the administration of the issue of coal production licenses to the coal mining enterprises other than those mentioned in the preceding paragraph. 省、自治区、直辖市人民政府煤炭管理部门可以授权设区的市、自治州人民政府煤炭管理部门负责煤炭生产许可证的颁发管理工作。 The departments in charge of the coal industry under the people's governments of the provinces, autonomous regions and municipalities directly under the central Government may authorize the departments in charge of the coal industry of the cities divided into districts and autonomous prefectures to be responsible for the administration of the issue of coal production licenses. 第二十五条煤炭生产许可证的颁发管理机关，负责对煤炭生产许可证的监督管理。 Article 25 The government departments in charge of the administration of the issue of coal production licenses shall be responsible for supervision over and administration of coal production licenses. 依法取得煤炭生产许可证的煤矿企业不得将其煤炭生产许可证转让或者出租给他人。 Coal mining enterprises may not transfer or lease to another person the coal production licenses they have legally obtained. 第二十六条在同一开采范围内不得重复颁发煤炭生产许可证。 Article 26 No duplicate coal production license shall be issued for mining in the same area. 煤炭生产许可证的有效期限届满或者经批准开采范围内的煤炭资源已经枯竭的，其煤炭生产许可证由发证机关予以注销并公告。 Where the validity period of a coal production license expires or the coal resources within the limits of an approved mining area are exhausted, the license-issuing authority shall revoke the license and make it known to the public. 煤矿企业的生产条件和安全条件发生变化，经核查不符合本法规定条件的，其煤炭生产许可证由发证机关予以吊销并公告。 Where the production 上一页 [1] [2] [3] [4] [5] [6] [7] [8] 下一页 实践证明经常访问无忧英语教育网 www.51education.net ,能迅速提高你的英语学习能力!积沙成塔,不断提高! 本站所提供的所有信息仅供学校课堂教学及英语学习者学习研究之用，其著作权归原作者及媒体所有。 |
