{0>恐怖袭击活动所致的伤残或身故。<}0{>TERRORISM EXCLUSION CLAUSE<0}

Notwithstanding any provision to the contrary within this insurance or any endorsement thereto, it is agreed that this insurance excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any act of terrorism regardless of any other cause or event contributing concurrently or in any other sequence to the loss.

For the purpose of this exclusion an act of terrorism means an act, including but not limited to the use of force or violence and/or the threat thereof, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organization(s) or government(s), committed for political, religious, ideological or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear.

This exclusion also excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any action taken in controlling, preventing, suppressing or in any way relating to any act of terrorism.

If the Company alleges that by reason of this exclusion, any loss, damage, cost or expense is not covered by this insurance the burden of proving the contrary shall be upon the Insured.

In the event any portion of this exclusion is found to be invalid or unenforceable, the remainder shall remain in full force and effect.

{0>被保险人所签署的要保书，是中国交通保险签保险单的根据，也是本保险单的组成部份。<}0{>The written application which the Insured has made and declared being the basis of issuing this policy must be true and correct.<0}{0>因此，被保险人须确实填报，如有虚报或提供伪证等情况，本保险单即行失效。<}0{> If any claim made shall be fraudulent or exaggerated or if any false declaration or statement shall be made in support thereof, then this Policy shall be void.<0}

{0>讼裁<}0{>Arbitration<0}

{0>所有由于本保险单所引起的争议，应提交一位仲裁人裁决，该仲裁人由争议双方以书面委任。<}0{>All differences arising out of this Policy shall be referred to the decision of an Arbitrator to be appointed in writing by the parties in difference <0}{0>如双方对该一被选之仲裁人不能同意时，则每方可于对方书面请求一个月内各委任一人为仲裁人决定之。<}0{>or if they cannot agree upon a single Arbitrator to the decision of two Arbitrators one to be appointed in writing by each of the parties within one calendar month after having been required in writing so to do by either of the parties <0}{0>如果该两位仲裁人不能取得一致意见，则应于仲裁未开始前由该两位仲裁人以书面委任一位公断人参与公断程序，并担任公断时之主席，作出公断。<}0{>or in case the Arbitrators do not agree of an Umpire appointed in writing by the Arbitrators before entering upon the reference. The Umpire shall sit with the Arbitrators and preside at their meetings .<0}{0>在公断人未作出公断书之前，被保险人不得对中国交通保险进行起诉。<}0{>and the making of an Award shall be a condition precedent to any right of action against China Communications Insurance<0} {0>如中国交通保险拒绝被保险人的任何赔偿要求，而被保险人在被拒绝后的十二个月内不根据本条款规定提交仲裁，则作为放弃索赔要求论。此后将不再获得赔偿。<}0{>If China Communications Insurance shall disclaim liability to the Insured for any claim hereunder and such claim shall not within twelve calendar months from the date of such disclaim have been referred to arbitration under the provisions herein contained, then the claim shall for all purposes be deemed to have been abandoned and shall not thereafter be recoverable hereunder.<0}

{0>任何向中国交通保险索偿诉讼之行动，应于意外事故发生后一年内提出。否则将丧失所有索偿及诉讼之权利。<}0{>Every action or proceeding against China Communications Insurance for the recovery of any claim under or by the virtue of this contract is absolutely barred unless commenced within one year after the accident occurs.<0}

{0>权利转让<}0{>Subrogation<0}

{0>中国交通保险有权以被保险人之名义向其它个人或团体追讨中国交通保险所支付之任何赔偿，而被保险人应协助及提交有关之文件给与中国交通保险以便索偿。<}0{>In the event that any payment is made under this Policy in respect of any claim, China Communications Insurance shall be subrogated to all the Insured
