{0>并指导待业保险机构做好待业保险基金的筹集、管理和发放以及待业职工的组织、管理等工作。<}0{>They shall guide the unemployment insurance institutions to work hard at raising, managing and distributing unemployment insurance funds, as well as at the organization and management of the staff and workers waiting for employment. <0}

{0>县级以上地方各级人民政府设立的待业保险基金委员会，实施对待业保险基金管理的指导和监督。<}0{>The unemployment insurance fund committees established by the people's governments above the county level shall carry out guidance and supervision of the management of unemployment insurance funds. The chair of such committee shall be held by the leading official of the people's government at the corresponding level. <0}

{0>委员会主任由本级人民政府负责人担任，劳动、财政、计（经）委、审计、银行等部门和本级总工会的负责人参加，办公室设在劳动行政主管部门。<}0{>Representative officials from such institutions as the labor, finance, (economic) planning, auditing and banks, as well as the representative official of the trade union at the corresponding level, shall participate in such committee. The office of the committee shall be set up in the competent labor administrative institution. <0}

{0>第十八条　地方待业保险机构为非营利性的事业单位，具体经办待业保险业务。<}0{>Article 18. The local unemployment insurance institutions shall be the non-profit institutions which shall specifically conduct the business relevant to unemployment insurance. <0}

{0>待业保险机构的人员编制，由省、自治区、直辖市人民政府根据实际需要确定。<}0{>The composition of personnel at the unemployment insurance institutions shall be determined by the people's government of the province, autonomous region or municipality directly under the Central Government with regard to actual need. <0}

{0>待业保险机构的经费在待业保险管理费中列支。<}0{>The expenditures of the unemployment insurance institutions shall be paid out of the unemployment insurance management fees. <0}

{0>待业保险管理费的开支标准，由省、自治区、直辖市人民政府劳动行政主管部门提出，经同级财政行政主管部门审核，报本级人民政府批准。 <}0{>The competent labor administrative institutions of the people's government of the province, autonomous region and municipality directly under the Central Government shall propose the expenditure standards for the unemployment insurance management fees upon the examination and verification of the competent financial administrative institutions at the same level, per the approval of people's government at the corresponding level. <0}

{0>第五章　罚  则 <}0{>Chapter V Punishment <0}

{0>第十九条　以非法手段领取待业救济金和其他待业保险费用的，由待业保险机构追回其全部非法所得；构成犯罪的，依法追究刑事责任。<}0{>Article 19. In cases where unemployment relief funds and other unemployment insurance fees were obtained by illegal means, all illegal proceeds shall be recovered by unemployment insurance institutions. If a crime has been committed, criminal liability shall be investigated according to law. <0}

{0>第二十条　任何单位和个人挪用待业保险基金的，对主管人员和直接责任人员，根据情节轻重，给予行政处分；构成犯罪的，依法追究刑事责任。<}0{>Article 20. In cases where any unit or individual embezzles unemployment insurance funds, administrative punishment shall be imposed upon the personnel in charge and the personnel directly held responsible in accordance with the seriousness of the cases. If a crime has been committed, criminal liability shall be investigated according to law. <0}

{0>第二十一条　待业保险机构违反规定拖欠支付待业救济金和其他待业保险费的，由劳动行政主管部门责令改正；<}0{>Article 21. In cases where unemployment insurance institutions are in violation of the regulations relevant to the deferment of payment of unemployment relief funds and other unemployment insurance fees, the competent labor administrative institutions shall be ordered to make the necessary corrections. <0}

{0>情节严重的，对主管人员和直接责任人员给予行政处分。 <}0{>If the circumstances are serious, administrative punishment shall be imposed upon the personnel in charge and the personnel directly responsible. <0}

{0>第六章　附  则 <}0{>Chapter VI Supplementary Provisions <0}

{0>第二十二条　实行企业化管理的事业单位职工待业保险，依照本规定执行，待业保险费在事业单位自有资金中列支。<}0{>Article 22. Unemployment insurance of the staff and workers waiting for employment from the institutions practicing enterprise management shall be implemented in accordance with the provisions of these Regulations. The unemployment insurance premium of the institutions shall be paid out of locally controlled funds. <0}

{0>第二十三条　本规定不适用企业招用的农民合同制工人。<}0{>Article 23. These Regulations shall not apply to the contracted workers who are recruited from rural areas by the Enterprises. <0}

{0>第二十四条　省、自治区、直辖市人民政府可以根据本规定制定实施办法。<}0{>Article 24. The people's government of the province, autonomous region and municipality directly under the Central Government shall, in light of the provisions of these Regulations, formulate the measures for implementation. <0}

{0>第二十五条　本规定由国务院劳动行政主管部门负责解释。<}0{>Article 25. These Regulations shall be interpreted by the competent labor administrative institution under the State Council. <0}

{0>第二十六条　本规定自一九九三年五月一日起施行。一九八六年七月十二日国务院发布的《国营企业职工待业保险暂行规定》同时废止。<}0{>Article 26. These Regulations shall be implemented as of May 1, 1993. The "Interim Regulations on Unemployment Insurance for Staff and Workers of the State-owned Enterprises" issued by the State Council on July 12, 1986 shall, at the same time, become void.<0}
