{0> （四）使用保留期内的企业名称从事生产经营活动或者保留期届满不按期将《企业名称登记证书》交回登记主管机关的，予以警告或者处以五百元以上、五千元以下罚款；  <}0{>(4) In the case of the use of an enterprise name for production or business operation during the period of its reservation or the failure to hand back the Certificate of Enterprise Name Registration to the competent registration authority within the time limit at the expiry of the reservation period, a warning shall be issued or a fine of more than 500 but less than 5,000 yuan (RMB) shall be imposed; <0}

{0> （五）违反本规定第二十条规定的，予以警告并处以五百元以上、五千元以下罚款。<}0{>(5) In the case of a violation of Article 20 of these Provisions, a warning shall be issued and a fine of more than 500 but less 5,000 yuan (RMB) concurrently shall be imposed. <0}

{0> 第二十七条 擅自使用他人已经登记注册的企业名称或者有其他侵犯他人企业名称专用权行为的，被侵权人可以向侵权人所在地登记主管机关要求处理。<}0{>Article 27 Where the registered name of one enterprise is used without authorization by another enterprise or the former's exclusive right to use of its registered name is infringed in any other way, the infringed party may apply to the registration authority of the area where the infringer is located for handling the case. <0}

{0>登记主管机关有权责令侵权人停止侵权行为，赔偿被侵权人因该侵权行为所遭受的损失，没收非法所得并处以五千元以上、五万元以下罚款。<}0{>The registration authority has the power to order the infringer to cease the infringement and compensate the infringed party for the loss thus incurred, and to confiscate the illegal income and impose concurrently a fine of more than 5,000 but less than 50,000 yuan (RMB). <0}

{0> 对侵犯他人企业名称专用权的，被侵权人也可以直接向人民法院起诉。<}0{>The infringed party may bring a suit directly in the people's court for handling a case of infringement on the exclusive right to use of a registered name. <0}

{0> 第二十八条 对登记主管机关根据本规定作出的具体行政行为不服的，当事人可以在收到通知之日起十五日内向上一级登记主管机关申请复议。<}0{>Article 28 Any party dissatisfied with the specific administrative act taken by a competent registration authority under these Provisions may, within 15 days from receipt of the decision, apply to the competent registration authority at the next higher level for reconsideration.  <0}

{0>上级登记主管机关应当在收到复议申请之日起三十日内作出复议决定。对复议决定不服的，可以依法向人民法院起诉。<}0{>The competent registration authority at the next higher level shall make a decision of reconsideration within 30 days from the date of receipt of the application. Any party dissatisfied with the decision of the reconsideration made by the said authority may file a suit in the people's court according to law.<0}

{0> 逾期不申请复议，或者复议后拒不执行复议决定，又不起诉的，登记主管机关可以强制更改企业名称，扣缴企业营业执照，按照规定程序通知其开户银行划拨罚没款。<}0{>If no application for reconsideration is made up to the expiration of the said period, or the decision of the reconsideration is not accepted after the reconsideration and no suit is filed in the people's court, the registration authority may force the enterprise to change its name, revoke its business license and notify the bank to withhold the fine or the confiscation involved from its account according to stipulated procedure. <0}

{0> 第二十九条 外国（地区）企业可以在中国境内申请企业名称登记注册。<}0{>Article 29 An enterprise of a foreign country (region) may apply for registration of its name in the territory of China. <0}

{0> 外国（地区）企业应当向国家工商行政管理局提出企业名称登记注册的申请，并提交外国（地区）企业法定代表人签署的申请书、外国（地区）企业章程和企业所在国（地区）主管当局出具的合法开业证明。<}0{>A foreign (regional) enterprise shall apply to the State Administration for Industry and Commerce for its name registration with the submission of an application signed by its legal representative, its articles of association and a certificate of its legal business operation issued by a competent authority of the country (region) where the enterprise comes from. <0}

{0>登记主管机关应当在收到外国（地区）企业申请名称登记注册的全部材料之日起三十日内作出初步审查，通过初审的，予以公告。<}0{>The competent registration authority shall make a preliminarily examination thereof within a period of 30 days from the date of receipt of the papers necessary for the registration. If the application is preliminarily approved, an announcement shall be published. <0}

{0>外国（地区）企业名称的公告期为六个月，在此期间无异议或者异议不成立的，予以核准登记注册，企业名称保留期为五年。<}0{>The period of announcement for a foreign (regional) enterprise is six months. If no objection is filed within the period or if the objection is not justified, the registration shall be approved and the period of reservation of the registered enterprise name shall be five years.<0}

{0>登记主管机关核准登记注册外国（地区）企业名称后，应当核发《企业名称登记证书》。<}0{> After a foreign (regional) enterprise name registration is approved, a Certificate of Enterprise Name Registration shall be issued by the competent registration authority. <0}

{0>外国（地区）企业名称登记注册后需要变更或者保留期届满要求续展的，应当重新申请登记注册。<}0{>Where a foreign (regional) enterprise intends to make a change after the registration of its enterprise name or to extend its reservation period on its expiry, a new application for registration shall be made. <0}

{0> 第三十条 在登记主管机关登记注册的事业单位及事业单位开办的经营单位的名称和个体工商户的名称登记管理，参照本规定执行。<}0{>Article 30 The registration and control of the name of an institution, business unit operated by an institution or an individual industrial or commercial household which is to be registered with a competent registration authority shall be handled with reference to these Provisions. <0}

{0> 第三十一条 本规定施行前已经核准登记注册的企业名称，准予继续使用，但严重不符合本规定的，应予纠正。<}0{>Article 31 The continuous use of an enterprise name that has been approved and registered prior to the effectiveness of these Provisions shall be allowed. However, a rectification is required for any such name which is in serious discord with these Provisions. <0}

{0> 第三十二条 《企业名称登记证书》由国家工商行政管理局统一印制。<}0{>Article 32 The Certificate of Enterprise Name Registration shall be uniformly made by the State Administration for Industry and Commerce. <0}

{0> 第三十三条 本规定由国家工商行政管理局负责解释。<}0{>Article 33 The State Administration for Industry and Commerce is responsible for the interpretation of these Provisions. <0}

{0> 第三十四条 本规定自一九九一年九月一日起施行。<}0{>Article 34 These Provisions shall enter into effect as of September 1, 1991. <0}
