{0> 第一章  总  则<}0{>Chapter I   General Provisions <0}

{0>第一条  为保护计算机软件著作权人的权益，调整计算机软件在开发、传播和使用中发生的利益关系，鼓励计算机软件的开发与流通，促进计算机应用事业的发展，依照《中华人民共和国著作权法》的规定，制定本条例。<}0{>Article1. In order to protect the rights and interests of creators of computer software, to adjust the relationships of interest during the development, dissemination and use of computer software, to encourage the development and circulation of computer software, and to promote the development of computer applications these regulations are enacted in accordance with the provisions of the Copyright Law of the People's Republic of China. <0}

{0>第二条  本条例所称的计算机软件（简称软件，下同）是指计算机程序及其有关文档。<}0{>Article2. For the purposes of these regulations computer software (hereinafter referred to as software) refers to computer programs and related documentation. <0}

{0>第三条  本条例下列用语的含义是：<}0{>Article3. Meanings of the following words used in these regulations are: <0}

{0>（一）计算机程序：指为了得到某种结果而可以由计算机等具有信息处理能力的装置执行的代码化指令序列，或者可被自动转换成代码化指令序列的符号化指令序列或者符号化语句序列。<}0{>(1) Computer programs: refers to coded instructional sequences-or those symbol ic instructional sequences or numeric language sequences which can be automatically converted into coded instructional sequences-which are for the purpose of obtaining a certain result and which are operated on information processing equipment such as computers. <0}

{0>计算机程序包括源程序和目标程序。同一程序的源文本和目标文本应当视为同一作品。<}0{>Computer programs include source code programs and object code programs. The source code text of a piece of software and its object code text should be seen as one work. <0}

{0>（二）文档：指用自然语言或者形式化语言所编写的文字资料和图表，用来描述程序的内容、组成、设计、功能规格、开发情况、测试结果及使用方法，如程序设计说明书、流程图、用户手册等。<}0{>(2) Documentation: refers to written materials and diagrams, using natural language or formal language, which are used to describe the contents, organization, design, functions and specifications, development circumstances, testing results and method of use of the program, for example: program design explanations, flow charts, user manuals, etc. <0}

{0>（三）软件开发者：指实际组织、进行开发工作，提供工作条件以完成软件开发，并对软件承担责任的法人或者非法人单位（简称单位，下同）；依靠自己具有的条件完成软件开发，并对软件承担责任的公民。<}0{>(3) Software developers: refers to those legal persons or units which are not legal persons (hereinafter referred to as units) who actually organize, undertake the work of development, and provide working conditions to complete the development of software and who take responsibility for the software as well; citizens who rely on their own conditions to complete software and who take responsibility for the software. <0}

{0>（四）软件著作权人：指按本条例的规定，对软件享有著作权的单位和公民。<}0{>(4) Software copyright owners: refers to those units and citizens who, in accordance with these regulations, enjoy the copyright of a computer software. <0}

{0>（五）复制：指把软件转载在有形物体上的行为。<}0{>(5) Reproduction: refers to the act of transferring software into a material form. <0}

{0>第四条  本条例所称对软件的保护，是指软件的著作权人或者其受让者享有本条例规定的软件著作权的各项权利。<}0{>Article4. The provision of protection to computer software, as referred to in these regulations, refers to (the fact that) that computer software copyright holders or transferees enjoy all the rights of copyright stipulated in these regulations. <0}

{0>第五条  受本条例保护的软件必须由开发者独立开发，并已固定在某种有形物体上。<}0{>Article5. Software which enjoys protection under these regulations must be independently developed by the developer and must already be in material form. <0}

{0>第六条  中国公民和单位对其所开发的软件，不论是否发表，不论在何地发表，均依照本条例享有著作权。  <}0{>Article6. Chinese citizens and units enjoy the copyright under these regulations for software they have developed, regardless of whether it has been published and regardless of where it has been published. <0}

{0>外国人的软件首先在中国境内发表的，依照本条例享有著作权。<}0{>Foreigner's software first published in China enjoys the copyright under these regulations. <0}

{0>外国人在中国境外发表的软件，依照其所属国同中国签订的协议或者共同参加的国际条约享有的著作权，受本条例保护。<}0{>Software published outside of China by foreigners enjoys copyright in China and protection under these regulations according to a bilateral agreement signed between the country to which it belongs and China or according to international convention to which they are both parties. <0}

{0>第七条  本条例对软件的保护不能扩大到开发软件所用的思想、概念、发现、原理、算法、处理过程和运行方法。<}0{>Article7. The protection provided to software under these regulations cannot be expanded to encompass the ideas, concepts, discoveries, principles, algorithms, processing methods and operations used in the development of computer software. <0}

{0>第八条  国务院授权的软件登记管理机构主管全国软件的登记工作。<}0{>Article8. The State Council's designated software registration agency administers the registration of software throughout the entire country. <0}

{0>第二章  计算机软件著作权<}0{>Chapter II   Computer Software Copyrights <0}

{0>第九条  软件著作权人享有下列各项权利：  <}0{>Article9. Software copyright holders enjoy the following rights: <0}

{0>（一）发表权，即决定软件是否公之于众的权利；<}0{>(1) Right of publication, is the right to decide whether the software should b e released to the public; <0}

{0>（二）开发者身份权，即表明开发者身份的权利以及在其软件上署名的权利；<}0{>(2) Developer's right of authorship, is the right to indicate the developer's identity and to place his name on the software; <0}

{0>（三）使用权，即在不损害社会公共利益的前提下，以复制、展示、发行、修改、翻译、注释等方式使用其软件的权利；  <}0{>(3) The right of use, is the right to use the software by copying, demonstrating, distributing, altering, translating, annotating, etc., under the precondition of not
