{0>第一条 根据《中华人民共和国仲裁法》和有关法律的规定,制定本仲裁规则。<}0{>Article 1 These Rules are formulated in accordance with the Arbitration Law of the People's Republic of China and the provisions of the relevant laws.<0}

{0>第二条 中国海事仲裁委员会 (原名中国国际贸易促进委员会海事仲裁委员会, 以下简称仲裁委员会) 以仲裁的方式，独立、公正地解决海事、海商、物流争议以及其他契约性或非契约性争议，以保护当事人的合法权益, 促进国际国内经济贸易和物流的发展。<}0{>Article 2 China Maritime Arbitration Commission (formerly known as Maritime Arbitration Commission of the China Council for the Promotion of International Trade, and hereinafter referred to as "the Arbitration Commission" or CMAC) independently and impartially resolves, by means of arbitration, admiralty, maritime, logistic disputes and other contractual or non-contractual disputes, in order to protect the legitimate rights and interests of the parties and promote the development of the international and domestic economy, inter alia, trade and logistics.<0}

{0>仲裁委员会受理下列争议案件：<}0{>The Arbitration Commission shall take cognizance of cases relating to the following disputes：<0}

{0>(一) 租船合同、多式联运合同或者提单、运单等运输单证所涉及的海上货物运输、水上货物运输、旅客运输争议；<}0{>(1) Disputes arising from charter party, contract of multi-model transport, bill of lading, waybill or any other transport documents in connection with carriage of goods by sea or waters, or carriage of passengers;<0}

{0>(二) 船舶、其他海上移动式装置的买卖、建造、修理、租赁、融资、拖带、碰撞、救助、打捞,或集装箱的买卖、建造、租赁、融资等业务所发生的争议；<}0{>(2) Disputes arising from sale, construction, repair, chartering, financing, towage, collision, salvage or raising of ships or other offshore mobile units, or from sale, construction, chartering, financing and other relative business of containers;<0}

{0>(三) 海上保险、共同海损及船舶保赔业务所发生的争议；<}0{>(3) Disputes arising from marine insurance, general average or ship's protection and indemnity;<0}

{0>(四) 船上物料及燃油供应、担保争议,船舶代理、船员劳务、港口作业所发生的争议；<}0{>(4) Disputes arising from supply or security of ship's stores or fuel, ship's agency, seamen's labor service or port's handling;<0}

{0>(五) 海洋资源开发利用、海洋环境污染所发生的争议；<}0{>(5) Disputes arising from exploitation and utilization of marine resources or pollution damage to marine environment;<0}

{0>(六) 货运代理，无船承运，公路、铁路、航空运输，集装箱的运输、拼箱和拆箱，快递，仓储，加工，配送，仓储分拨，物流信息管理，运输工具、搬运装卸工具、仓储设施、物流中心、配送中心的建造、买卖或租赁，物流方案设计与咨询，与物流有关的保险，与物流有关的侵权争议，以及其它与物流有关的争议；<}0{>(6) Disputes arising from freight forwarding, non-vessel operating common carriage, transport by highway, railway or airway, transport, consolidation and devanning of containers, express delivery, storing, processing, distributing, warehouse distributing, logistics information management, or from construction, sale and leasing of tools of transport, tools of carrying and handling, storage facilities, or from logistics center and distribution center, logistics project planning and consulting, insurance related to logistics, tort or others related to logistics;<0}

{0>(七) 渔业生产、捕捞等所发生的争议；<}0{>(7) Disputes arising from fishery production or fishing; and<0}

{0>(八) 双方当事人协议仲裁的其他争议。<}0{>(8) Other disputes submitted for arbitration by agreement between parties.<0}

{0>第三条 仲裁委员会根据当事人在争议发生之前或者之后达成的将争议提交仲裁委员会仲裁的仲裁协议和一方当事人的书面申请,受理案件。<}0{>Article 3 The Arbitration Commission takes cognizance of cases in accordance with an arbitration agreement between the parties concluded before or after the occurrence of the dispute to refer their dispute to the Arbitration Commission for arbitration and upon the written application by one of the parties.<0}

{0>　　仲裁协议系指当事人在合同、提单、运单或援引的文件中订明的仲裁条款,或者以其他方式达成的提交仲裁的书面协议。<}0{>An arbitration agreement means an arbitration clause stipulated by the parties in their contract, bill of lading, waybill, documents invoked or a written agreement concluded by the parties in other forms to submit their dispute for arbitration.<0}

{0>　　当事人约定在仲裁委员会仲裁或约定适用本仲裁规则的，本仲裁规则即构成当事人仲裁协议的组成部分，但当事人另有约定者除外。<}0{>Where the parties agree to submit their dispute to the Arbitration Commission for arbitration or agree to conduct the arbitration under these Rules, these Rules shall constitute a part of the arbitration agreement concluded by parities, except that the parties have otherwise agreed.<0}

{0>第四条 仲裁委员会有权对仲裁协议的存在、效力以及仲裁案件的管辖权作出决定。<}0{>Article 4 The Arbitration Commission has the power to decide on the existence, validity of an arbitration agreement and the jurisdiction over an arbitration case.<0}

{0>　　当事人对仲裁协议的效力有异议的，如果一方申请仲裁委员会作出决定，另一方申请人民法院作出裁定，由人民法院裁定。但是，对仲裁协议效力的异议，如果仲裁委员会先于人民法院接受申请并已作出决定，以仲裁委员会的决定为准。<}0{>If a party challenges the validity of the arbitration agreement and requests the Arbitration Commission to make a decision thereupon while the other party applies to the people's court for a ruling, the latter's ruling shall prevail. However, in case of a challenge made against the validity of an arbitration agreement, if the acceptance of the application by the Arbitration Commission precedes that by the people's court and a decision is made thereupon, the decision by the Arbitration Commission shall prevail.<0}

{0>第五条 仲裁协议独立存在,合同的变更、解除、终止、失效或无效以及存在与否,均不影响仲裁协议的效力。<}0{>Article 5 An arbitration agreement shall exist independently. The validity of an arbitration agreement shall not be affected by the modification, rescission, termination, invalidity, revocation or non-existence of the contract.<0}

{0>　　仲裁庭有权确认合同的效力，仲裁庭有权决定仲裁程序未决事项。<}0{>The arbitration tribunal has the power to affirm the validity of a contract, as well as unsettled procedural issues in arbitration.<0}
